Guest WLAN terms of use

 

The operator provides access to the Internet in its business premises in the form of a guest WLAN access (WLAN hotspot) for use free of charge. These terms of use govern the rights and obligations of the operator and the user associated with the shared use of the guest WLAN access.

Services

Internet access is granted to the user free of charge for the duration of their stay, whereby the provision is based on the respective technical and operational possibilities of the operator. The user is not authorised to allow third parties to use the WLAN.

There is no entitlement to a specific local coverage, a specific transmission speed or a functioning WLAN hotspot. In particular, the operator reserves the right to change, restrict or discontinue guest WLAN access without prior notice in the event of necessary technical repair and maintenance work.

The operator is neither willing nor obliged to guarantee the actual availability, suitability or reliability of Internet use for a specific purpose or specific services, including in terms of volume.

Access and utilisation

Guest WLAN access can be used by visitors to the operator's company. It is not a publicly accessible telecommunications service, but an internal guest WLAN for visitors.

The prerequisite for using the guest WLAN access is that the user accepts the validity of these terms of use before using the WLAN hotspot. This is done when selecting the hotspot: weko-hotspot as the Wi-Fi network in the end device via a welcome page.

There is no entitlement to use the WLAN hotspot. The operator is free to restrict or discontinue access to the WLAN hotspot at any time without giving reasons.

The current version of these terms of use applies. This will be made available to the user logging in to the WLAN hotspot

Blocking access

The operator may temporarily or permanently block access to the WLAN hotspot at any time if there are concrete indications that the user is violating or has violated these terms of use and/or applicable law or if the operator has another legitimate interest in blocking access.

The operator reserves the right, at its reasonable discretion, to block access to certain pages or services via the WLAN at any time.

Security

Data transmission between the guest WLAN and the user's WLAN-enabled end device is wireless. It cannot be ruled out that third parties may gain unauthorised access to the data to be transmitted via the guest WLAN. The user expressly acknowledges that the use of the Internet and the transmission of data, in particular via a WLAN connection, are associated with increased danger and security risks. It is the responsibility of the user to configure the security of their software so that data transmission is protected against access by third parties.

For security reasons, the connection is disconnected after 24 hours. Dialling in is then possible again at any time during our business hours in accordance with the provisions of the WLAN contract.

Access data

The user is liable for any use and/or other activity carried out under his access in accordance with the statutory provisions.

Prohibited acts

When using the WLAN hotspot, the user is prohibited from any actions that violate applicable law, infringe the rights of third parties or violate the principles of the protection of minors. In particular, the following actions are prohibited:

• the posting, distribution, offering and advertising of pornographic content, services and/or products that violate youth protection laws, data protection laws and/or other laws and/or fraudulent content, services and/or products;

• publishing or making available content that insults or defames other participants or third parties;

• the use, provision and distribution of content, services and/or products that are legally protected or encumbered with third-party rights (e.g. copyrights) without being expressly authorised to do so;

• the making available to the public of copyright-protected works or other acts in breach of copyright, in particular when using so-called "Internet file-sharing networks" or file-sharing services.

Furthermore, the following activities are also prohibited, irrespective of any violation of the law, when posting your own content on the service provider's website and when communicating with other users (e.g. by sending personal messages, participating in discussion forums, etc.):

• the transmission of above-average data volumes and in particular the continuous transmission of such data volumes;

• the hosting of a web server or other servers by using a WLAN hotspot of the service provider;

• changing the default DNS servers in the network settings of the service provider's Wi-Fi hotspot;

• the sending of junk or spam mails and chain letters;

• the spread of viruses, Trojans and other malicious files;

• the dissemination of lewd, offensive, sexually explicit, obscene or defamatory content or communication as well as content or communication that is likely to promote or support racism, fanaticism, hatred, physical violence or unlawful acts (in each case explicitly or implicitly);

• requesting other users or third parties to disclose passwords or personal data for commercial or illegal or unlawful purposes.

Any action that is likely to impair the smooth operation of the WLAN hotspot is also prohibited.

Exemption from liability

The user is responsible for all their own actions in connection with the use of the Internet via WLAN hotspot.

The user shall indemnify the operator against all claims asserted by third parties against the operator due to a breach by the user of statutory provisions, third-party rights (in particular personal rights, copyrights and trademark rights) or contractual obligations, warranties or guarantees, including the costs of the necessary legal defence (legal fees and court costs at the statutory rate) upon first request.

In the event that claims are asserted against the operator, the user is obliged to cooperate immediately and fully in clarifying the facts of the case and to provide us with the necessary information in a suitable manner.

Limitation of liability

The operator is liable without limitation for all damage caused by him in the event of intent or gross negligence.

In the event of slight negligence, the operator shall be liable without limitation in the event of injury to life, limb or health.

Furthermore, the operator shall be liable if it has breached a material contractual obligation. Essential contractual obligations are abstractly defined as those obligations whose fulfilment is essential for the proper execution of the contract and on whose compliance the user may regularly rely. In these cases, liability is limited to compensation for foreseeable, typically occurring damages.

Insofar as the liability of the operator is excluded or limited in accordance with the aforementioned provisions, this shall also apply to its vicarious agents.

Liability under the Product Liability Act remains unaffected.

Data protection

The operator shall ensure that the user's personal data is only collected, stored and processed insofar as this is necessary for the contractual provision of services and is permitted by law or ordered by the legislator.

In the event that declarations of consent under data protection law are obtained from the user in the context of the use of the operator's services, it is pointed out that the user can revoke these at any time with effect for the future.

The technical provision of a guest WLAN requires the use of certain data from the user's end device. In this context, the MAC addresses, the name of the end device and an IP address assigned by the operator are temporarily stored. It should be noted that the designation of this address varies depending on the manufacturer. The aforementioned data is collected by the operator exclusively for the provision of Internet access, i.e. within the scope of technical necessity.

The user has the right

The user has the right: 

-  to information (pursuant to Art. 15 GDPR) about the personal data concerning him/her and
- to rectification (Art. 16 GDPR), 
- Erasure (Art. 17 GDPR), and 
- to restriction of processing (Art. 18 GDPR). Furthermore, the user has a 
- Right to object to the processing (Art. 21 GDPR) and 
- the right to data portability (Art. 20 GDPR).

 

Final provisions

The law of the Republic of Poland shall apply, whereby the application of the UN Convention on Contracts for the International Sale of Goods is excluded.

If the user is a merchant, a legal entity under public law or a special fund under public law, the registered office of the operator shall be the exclusive place of jurisdiction for all disputes arising from the contractual relationship.

Should individual provisions of these terms of use be or become invalid, this shall not affect the validity of the remaining provisions.
